1. Definitions
- "Service" refers to yacht charter services provided by Brine Compass
- "User," "you," or "guest" refers to individuals booking or participating in charters
- "We," "us," or "our" refers to Brine Compass
- "Vessel" refers to any yacht or boat used for charter services
- "Charter" refers to the booking and use of a vessel for a specific period
2. Acceptance of Terms
By booking a charter with Brine Compass or using our website, you agree to these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
You must be at least 18 years old or have parental/guardian consent to book our services. By booking, you confirm you have the legal capacity to enter into this agreement.
3. Service Description
Brine Compass provides yacht charter services in Langkawi waters, Malaysia. Our services include:
- Eagle Feeding Cruise (3-hour morning charter)
- Four Islands Circuit (full-day island hopping charter)
- Andaman Overnight Anchorage (two-day, one-night voyage)
Service availability is subject to weather conditions, vessel maintenance schedules, and crew availability. We reserve the right to modify itineraries for safety reasons.
4. Booking and Reservations
4.1 Booking Process
Bookings can be made through our website contact form, email, or phone. A booking is confirmed only after:
- Receipt of completed booking form with guest information
- Payment of required deposit
- Receipt of written confirmation from Brine Compass
4.2 Payment Terms
- Deposit: 40% of charter price required at booking
- Balance: Due 3 days before departure date
- Payment Methods: Bank transfer, credit card (processing fees may apply)
- Currency: All prices in Malaysian Ringgit (MYR)
5. Cancellation and Refund Policy
5.1 Guest Cancellations
- More than 14 days before departure: Full refund minus 10% administrative fee
- 7-14 days before departure: 50% refund
- Less than 7 days before departure: No refund
- No-show: No refund
5.2 Operator Cancellations
If we cancel due to weather, mechanical issues, or other circumstances:
- Full refund or rescheduling at no additional cost
- No liability for consequential expenses (travel, accommodation)
- Notification provided as soon as possible, typically 24 hours in advance
6. User Responsibilities
Guests must:
- Arrive at designated meeting point 15 minutes before departure
- Provide accurate information about group size and special requirements
- Follow crew instructions regarding safety and vessel operation
- Behave responsibly and not endanger themselves or others
- Not bring prohibited items (weapons, illegal substances)
- Report any medical conditions or mobility limitations in advance
- Respect vessel property and environment
7. Prohibited Conduct
The following behaviours are strictly prohibited:
- Intoxication or drug use that impairs safety
- Harassment or abusive behaviour toward crew or other guests
- Damage to vessel property or equipment
- Interference with vessel operation or safety systems
- Swimming in prohibited areas or against crew advice
We reserve the right to terminate a charter immediately if prohibited conduct occurs, with no refund.
8. Liability and Insurance
8.1 Our Liability
Brine Compass maintains public liability insurance and operates vessels in compliance with Malaysian maritime regulations. However, our liability is limited as follows:
- We are not liable for injuries resulting from failure to follow crew instructions
- We are not liable for loss or damage to personal belongings
- We are not liable for consequential damages (missed flights, accommodation costs)
- Maximum liability limited to charter price paid
8.2 Guest Insurance
We strongly recommend guests obtain travel insurance covering marine activities, medical expenses, and trip cancellation.
9. Disclaimers
Services are provided "as is" without warranties of any kind. We specifically disclaim:
- Weather Conditions: We cannot control or predict weather
- Wildlife Sightings: We cannot ensure specific wildlife encounters
- Itinerary Changes: Routes may be modified for safety or operational reasons
- Medical Advice: Our crew provides first aid only, not medical diagnosis or treatment
10. Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control, including severe weather, natural disasters, government actions, mechanical failure, or labour disputes.
11. Privacy
Personal information is collected and used in accordance with our Privacy Policy. By using our services, you consent to such processing.
12. Intellectual Property
All content on our website, including text, images, logos, and design, is owned by Brine Compass and protected by Malaysian copyright laws. Unauthorized use is prohibited.
13. Indemnification
You agree to indemnify Brine Compass against claims arising from your violation of these Terms, negligent or wilful misconduct, or failure to follow crew instructions.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kedah, Malaysia.
15. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of services after modifications constitutes acceptance of revised Terms.
16. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
